I’m just having a bit ouf trouble with Paul Neal’s “PEN Tools” in Max 2009.
When I try to load them I get this error – Any ideas how I could fix this?

Can you at least tell me what your fix was? I’m guessing it is because of 64bit?

Yes, it turned out to be the 64 bit thing! I don’t really have a good solution to that, except running it on a 32 bit machine

Is it the PEN Rigging Utils that you are trying to use?
If so there is a Max 2008 and above version.
